Waiver

I certify that I am at least 18 years of age. If signing on behalf of a minor, I certify that I am a parent or legal guardian of the minor and can sign legal documents on his or her behalf.

I acknowledge that this agreement is irrevocable and binding on me, my parent(s) or legal guardian(s), my child(ren), family members, estate, heirs, assigns, personal representatives, next of kin, and spouse. I agree to the terms set forth in this Agreement.

As a parent or legal guardian of my child, I fully consent to my child participating in the Virtual Reality Experience ("VR Experience"). I fully understand and acknowledge that this Agreement is binding upon me and the minor I represent and is intended to release Seaside VR LLC and its respective and collective agents, owners, managers, members, volunteers, participants, employees, and all other persons or entities acting in any capacity on their respective or collective behalf ("Seaside VR") from any liability arising from my or my child's participation in the VR Experience.

I hereby irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue Seaside VR from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, related to or arising from my or my child's participation in the VR Experience and using Seaside VR premises, equipment, services, programs and activities, including without limitation any claim for negligence, arising from property damage or loss, personal or bodily injury, emotional injury, illness, or death, to the maximum extent allowed by Oregon law, except to the extent caused by the gross negligence or willful misconduct of Seaside VR.

Participation involves serious risks, including illness, nausea, motion sickness, dizziness, disorientation, vertigo, eye strain, headaches, photosensitive seizure risk, tripping, falling, loss of balance, collision with walls or other participants, muscle strain, serious injury, and/or property damage.

I and my child or dependent minor will strictly adhere to all safety guidelines and the Code of Conduct.

VR is a relatively new technology and I voluntarily assume all risks, known or unknown, associated with VR technology and free-roam VR arena activities.

The VR Experience may not be suitable for: pregnant women, individuals with epilepsy or seizure disorders, heart or respiratory conditions, and children younger than 10.

Participants with sensitive skin or skin allergies are responsible for understanding the risks of wearing VR equipment.

I assume full responsibility for all risks arising from participation, whether foreseeable or unforeseeable.

I represent that I and my child are fully capable — physically, medically, and mentally — to participate.

Participants are not under the influence of drugs or alcohol. Participation while impaired is strictly prohibited.

Seaside VR uses enterprise-grade virtual reality equipment. Each headset has an approximate replacement value of $1,200 USD. Total equipment per session may exceed $7,200 USD.

I agree to handle all VR equipment with reasonable care; follow all staff instructions; use both hands when putting on or removing headsets; not touch headset lenses with fingers or any object; not drop, throw, or strike any equipment; not remove the headset while walking or in motion; and immediately report any malfunction or damage.

Damage liability: I may be held responsible for damage resulting from intentional misuse, abuse, vandalism, or gross negligence. Seaside VR will not hold me liable for normal wear, malfunctions not caused by my actions, or accidental damage despite reasonable care.

Seaside VR is a family-friendly environment. No admittance if under the influence of drugs or alcohol. Staff may refuse entry or terminate sessions without refund.

Eyeglass frames smaller than 142mm wide and 50mm high will fit. Staff will check the fit before your session. Wear contact lenses if in doubt.

No food or drinks in the arena. The lobby is available before or after your session.

All equipment is sanitized after every use. Disposable face covers are available on request.

No bags, loose jewelry, or accessories in the arena. Use the secure cubbies. No shoes in most of the space. Clean socks are required in the arena — $3 a pair at checkout or the desk. Tie back long hair — hair ties are at the counter.

No horseplay. No running, jumping, punching, kicking, or aggressive contact. Walk, sidestep, crouch, lean. Never sprint. When the boundary grid appears, stop and step back.

If something feels wrong, stop. Close your eyes, stand still, raise your hand. Staff will assist you immediately.

No smoking or vaping anywhere on premises.

Age requirements: no guests under 11. Ages 11–17 require a parent or guardian signature. Ages 11–12 require a parent or guardian on-site. Colony Olympus, The Frozen City, The Outbreak, and The Asylum are suggested 18+.

Walk-ins welcome when available. Book online for guaranteed slots.

I acknowledge that I and my child may be photographed or video recorded while on Seaside VR premises. You will select your consent preference in the signature section.

If you consent: Seaside VR may use photographs and video recordings for promotional purposes including the website, social media, and marketing materials. Your name will not be associated with any media without additional written consent.

If you do not consent: no photographs or video of your likeness will be used for marketing. This does not affect your participation.

Indemnification: I agree to indemnify and hold harmless Seaside VR from and against any and all losses, liabilities, claims, obligations, costs, damages, and expenses, including attorney fees, incurred in the event that I assert a claim or lawsuit against Seaside VR.

Cancellation: more than 4 hours before session — full refund or free reschedule. Within 4 hours — one-time reschedule, no cash refund. No-shows are non-refundable. Staff-terminated sessions (rule violations) are non-refundable. Participant-terminated sessions: no refund; partial credit may be offered if stopped within the first 5 minutes.

Governing law: the law of the State of Oregon. Disputes resolved in Clatsop County, Oregon courts. Prevailing party entitled to reasonable attorney fees and costs.

By signing below, I understand that a court of law may find that I forever waived the rights I might have to maintain an action against Seaside VR. I have had a reasonable and sufficient opportunity to read and understand this entire document and consult with legal counsel, or have voluntarily waived my right to do so. I knowingly agree to be bound by all terms and conditions set forth herein. All releases, waivers, and promises are binding on any minor(s) listed below.
